1. Scope of Application

These General Terms and Conditions (GTC) apply to all deliveries from lunulis.com and others to the consumer. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activity.

Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but merely an invitation to place an order. By clicking the purchase confirmation "Buy/Order with obligation to pay," you submit a binding order for the goods listed on the order page. Your purchase contract is concluded when we accept your order by sending an order confirmation via email immediately after receiving your order. Please note that during the ordering process, you are obliged to enter an email address to which you have access.

3. Prices & Packaging

The prices listed in the offer at the time of the order apply. These are the final prices and already include the legally applicable value-added tax in Germany. For items that are on special offer at the time of purchase or for which a voucher has been redeemed, the reduced price is included in the final offer of the order.

The packaging becomes the property of the customer from the time of delivery.

4. Payment

In principle, we offer the following payment methods: Prepayment, Credit Card, PayPal, Direct Debit via PayPal, Sofort by Klarna, Financing via Klarna, Apple Pay, Google Pay. We reserve the right, for each order, not to offer certain payment methods and to refer to the payment methods we do offer.

  • Prepayment: If you select the prepayment option, we will provide our bank details in a separate email and deliver the goods after payment is received.

  • Credit Card: You pay directly during the order process by entering your credit card details. When the goods are shipped, your credit card will be charged with the actual invoice amount after deducting any discounts, vouchers, etc. For goods that are specially manufactured according to customer specifications or are clearly tailored to personal needs, your credit card will be charged immediately with the actual invoice amount after deducting any discounts, gift vouchers, etc.

  • PayPal: You pay directly via your PayPal account. After submitting your order, you will be redirected to PayPal and authorize the order value there. As soon as our PayPal account has been informed of your authorization, the shipment will be made. Your PayPal account will be charged immediately after successful authorization with the actual invoice amount after deducting any discounts, gift vouchers, etc.

  • Direct Debit via PayPal: If you have chosen direct debit as a payment method, you do not need to be registered with PayPal to pay the invoice amount. By confirming the payment instruction, you grant PayPal a direct debit mandate. PayPal will inform you of the date of the account debit (so-called prenotification). Upon submission of the direct debit mandate immediately after confirmation of the payment instruction, PayPal will instruct its bank to initiate the payment transaction. The payment transaction will be carried out and your account will be debited. Further information can be found during the order process.

  • Sofort by Klarna: In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer you the Klarna PayLater payment method. Payment is made to Klarna. Your personal data will be processed by Klarna in accordance with applicable data protection laws and as described in Klarna's privacy policy.

  • Purchase on Account via Klarna: In cooperation with Klarna AB (www.klarna.de), Sveavägen 46, Stockholm, Sweden, we offer you purchase on account as a payment option. Please note that Klarna Invoice is only available for consumers and that payment must be made to Klarna. When purchasing on account with Klarna, you always receive the goods first and always have a payment period of 14 days.   • Financing via Klarna: In cooperation with Klarna AB (www.klarna.de), Sveavägen 46, Stockholm, Sweden, we offer you installment purchase as a payment option. Please note that Klarna installment purchase is only available for consumers and that payment must be made to Klarna. With Klarna's financing service, you can flexibly pay for your purchase in monthly installments of at least 1/24 of the total amount (but at least €6.95).   • Apple Pay: On our website, we offer payment via Apple Pay, among others. If you select payment via Apple Pay, the payment data you entered will be transmitted to Apple Pay.   • Google Pay: If you opt for the "Google Pay" payment method from Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland ("Google"), payment processing takes place via the "Google Pay" application on your mobile device running at least Android 4.4 ("KitKat") and equipped with an NFC function, by debiting a payment card stored with Google Pay or a verified payment system there (e.g., PayPal). To approve a payment via Google Pay exceeding €25, prior unlocking of your mobile device via the respective verification measure (e.g., facial recognition, password, fingerprint, or pattern) is required. For the purpose of payment processing, the information provided by you during the ordering process, along with information about your order, will be transmitted to Google. Google then transmits your payment information stored in Google Pay in the form of a uniquely assigned transaction number to the originating website, with which a successful payment is verified. This transaction number contains no information about the real payment data of your payment methods stored with Google Pay, but is created and transmitted as a uniquely valid numerical token. In all transactions via Google Pay, Google merely acts as an intermediary for processing the payment process. The transaction is carried out exclusively in the relationship between the user and the originating website by debiting the payment method stored with Google Pay. According to Google, this processing is carried out exclusively in accordance with Art. 6 para. 1 lit. f GDPR on the basis of a legitimate interest in proper accounting, verification of transaction data, and optimization and maintenance of the Google Pay service. Google also reserves the right to combine the processed transaction data with other information collected and stored by Google when using other Google services. 5. Vouchers and Codes and Their Redemption

No vouchers or codes have been selected.

6. Right of Withdrawal

Right of Withdrawal You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement. This statement can be sent via letter, fax, or email. In this statement, you must provide your name (if applicable, company name), your address, and—if available—your phone number, fax number, and email address. You may use the form provided under the withdrawal instructions for this purpose; however, this is not mandatory. You may transmit this sample withdrawal form or any other clear statement of withdrawal to us. If you exercise your right of withdrawal, we will send you a confirmation of receipt of your withdrawal by email upon its arrival. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless we have expressly agreed otherwise with you in writing. In no event will you incur any fees as a result of this reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back or hand over the goods to us or to (here, if applicable, the name and address of the person authorized by you to receive the goods are to be inserted) without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You will bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

This right of withdrawal information does not apply to the separate delivery of goods.

8. Voluntary Right of Return

In addition to the statutory right of withdrawal described above, we offer you a voluntary right of return totaling 14 + 14 days from receipt of the goods. You can also withdraw from the contract after the 14-day withdrawal period has expired by returning the goods to us within 14 + 14 days of their receipt (period begins on the day after receipt of the goods), provided that the goods are complete and in their original packaging, are in unused and undamaged condition, and are not goods excluded from return under Section 312g of the German Civil Code (BGB). The goods must be returned to pheroXity.com. Our voluntary return guarantee does not affect your statutory rights and claims. In particular, your statutory right of withdrawal and your statutory warranty rights remain fully intact.

9. Delivery and Delivery Time

Deliveries are also possible abroad. Items are only supplied in customary household quantities and only to the end consumer.

12. Retention of Title

Until full payment is received, the goods remain the property of pheroXity.com and others.

13. Liability

We are liable without limitation for intent and gross negligence and according to the provisions of the Product Liability Act. In cases of slight negligence, we are generally only liable for injuries to life, body, and health of persons.

Should this not apply in a case of slight negligence, we are only liable in the event of a breach of essential contractual obligations. These are understood as obligations that enable the proper execution of the contract in the first place and on whose compliance the contractual partner relies. Liability for the breach of an essential contractual obligation is limited to the typical damage foreseeable at the time the contract was concluded based on the circumstances known at that time. This limitation of liability also applies in favor of our vicarious agents.
